THE National Drug Law Enforcement Agency (NDLEA) has, again, approached the Court of Appeal in Lagos for a stay of execution of the judgment of Justice Yetunde Idowu of an Ikeja High Court, which ordered it to pay the sum of N25 million to popular comedian, Babatunde Omidina, a.k.a Baba Suwe.
The agency, in the motion on notice, prayed the court to determine whether or not it is entitled to the grant of stay of execution of the judgment for the payment of the N25 million pending the determination of the appeal filed by it.
NDLEA further submitted it had shown exceptional and special circumstances upon which the Appeal Court would exercise its discretion in granting the application.
Justice Idowu had on November 24, 2011 ordered the agency to pay Baba Suwe the money as compensation for infringing on his right by detaining him for nine days.
